BEFORE-AND-AFTER-RULE
The Before-and-After Rule is a method used in eminent domain cases to determine the compensation owed to a property owner whose land has been taken by the government.
This rule requires the appraiser to determine the value of the property before the taking and then the value of the property after the taking, considering any enhancement or injury to the property that was the result of condemnation.
The rule is used in many jurisdictions to appraise the property value before the taking and after the taking. The difference between the two values is the amount of compensation owed to the property owner.
In real estate, the Before-and-After Rule is used to determine the value of a property before and after a project comes along.
